Compliance Monitoring System – MCACMS Portal

For timely enforcement of Compliance requirements under Companies Act 2013. MCA developed a dedicated online portal https://mcacms.gov.in/ . The purpose of Compliance Monitoring system is issue Show Cause notices to companies who fail to do compliances under Companies Act 2013. MCACMS Portal by Ministry of Corporate Affairs will issue electronic notice which carry certain details such as date of notice , Section , reference number etc.

Online Show cause notice to Companies from MCACMS Portal

MCA developed an Artificial Intelligence initiative under system in MCA 21. Purpose of this portal is to issue Show cause notice to companies for certain violation of Companies Act. Portal will send Show cause notice via mail to recipient. This notice will carry CMS reference Number such as F.No. D/RCXXX/XXX/2019/XX/YY-YY. And Under which section company having non compliances.

Procedure to Reply MCACMS Show Cause Notice

Procedure to Reply MCACMS Show Cause Notice of is completely online. There is no need to submit any physical documents etc. Recipient of notice need to login to MCACMS Portal and click on reply to show cause notice.

1. Login online to MCACMS Portal
2. Input CMS Reference number in portal
3. Generate OTP ( it will be sent on registered email address )
4. Input OTP in MCACMS Portal
5. Give reply in 500 words. If reply in more than 50o words t is advisable to print the same on Company letter head and authenticated by a Director / Company Secretary & submit
6. Submit reply & Record acknowledgment.

Time line to Reply MCACMS Show Cause Notice

Compliance Monitoring System (MCACMS Portal) is an Artificial Intelligence initiative under system in MCA 21. Which serve notice on mail to company and gives 15 days time from date of issue of notice to reply. For an example ABC Ltd received a notice on 1^st November 2019 for violation of Companies Act 2013. ABC Ltd need to reply in 15 days’ time to notice , due date to reply shall be 15 November 2019.

Penal Action on No Reply to MCACMS Show Cause Notice

Duration to reply MCACMS Show Cause Notice for recipient is 50 days from date of notice. Where company/ Director fail to reply Show cause notice it will be presumed that the company has nothing to say in the matter. After lapse of 15 days MCA shall initiate penal action fro violation of sections referred in show case notice. As per Companies Act fines, penalty MCA will take legal action on company/ director.
